Who we are
CONDITIONED. is a one-to-one behaviour and performance coaching practice run by Mardi Davies, a sole trader (ABN [TO CONFIRM]), Queensland, Australia. In this policy, "we", "us" and "CONDITIONED." mean Mardi Davies trading as CONDITIONED. Our website is conditionedcoach.com.
This policy explains what personal information we collect, why we collect it, who we share it with and how you can access or correct it. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We hold information that may be health information, so we apply the APPs even though we are a small business [TO CONFIRM with lawyer whether the Privacy Act applies to CONDITIONED. as a health service provider or by choice].
What we collect
Enquiries and bookings. Your name, email address, phone number, the service you are interested in and anything you write in the enquiry form. If you book for a teen, we also collect the parent or guardian's details and the teen's name and age.
During coaching. Notes about your goals, behaviour, performance, training or work situation, sleep, stress, relationships and wellbeing, as you choose to share them. Some of this is sensitive information, including health information (for example mental health or behaviour). We also hold session notes, workbook responses and any audio files you receive or provide.
Payments. Payments are processed by Stripe. Your card details are handled by Stripe and are not stored by CONDITIONED. We keep a record of what you bought, the amount, the date and a Stripe reference.
Website use. Our web host (Vercel) and other services may log technical details such as your IP address, browser type and the pages requested. Your browser's local storage is used only to remember the items in your cart. We do not currently use analytics or advertising cookies [TO CONFIRM before launch, and update this policy if that changes].
Why we collect it
- To respond to enquiries and run the free 15-minute call.
- To book, deliver and follow up your coaching, in person or online.
- To take payment, issue receipts and manage refunds.
- To keep appropriate records and meet legal, tax and insurance obligations.
- To keep you and others safe where there is a serious risk of harm.
- To improve our services, using information that does not identify you where we can.
We do not sell your personal information. We do not use it for marketing unless you have asked to hear from us or would reasonably expect it, and you can opt out at any time.
Sensitive and health information, and your consent
We only collect sensitive information, including health information, that is reasonably necessary for your coaching and only with your consent. By choosing to share it with us, you consent to us collecting, using and storing it for the purposes in this policy. You do not have to share anything you are not comfortable sharing. You can withdraw consent at any time by contacting us, though that may limit what we can do for you.
Coaching is not therapy, counselling, or medical or psychological treatment. If you need that kind of care, please see your GP or a registered psychologist.
Children and teens
Our Teen Mindset program is for people aged 13 to 17. A parent or guardian must agree to the coaching and to the collection of the teen's information before it begins [TO CONFIRM how consent is recorded]. We involve the parent or guardian in the program. We will talk with the teen about what we may share with their parent or guardian, and we will share information where needed to keep the teen safe. Nobody under 13 should use our services.
How we use and share your information
We share personal information only with:
- the service providers listed below, so they can do their job for us
- a person you have asked us to share with, or whose involvement you have agreed to (for example a parent or guardian, or your GP)
- authorities or other parties where the law requires or permits it, or where we reasonably believe it is necessary to prevent a serious threat to someone's life, health or safety, or to report child safety concerns
- our professional advisers, insurers and accountant, in confidence [TO CONFIRM]
Service providers and overseas disclosure
Some providers store or process information outside Australia, including in the United States and other countries. Under APP 8 we take reasonable steps to make sure they handle your information in line with the APPs, but we cannot control every aspect of how they operate. By using our website and services you accept this [TO CONFIRM wording with lawyer].

How we store and protect information
We keep information in secure, access-controlled systems and use reputable providers. Session notes are kept [TO CONFIRM how and where: for example encrypted cloud storage with a password and two-factor sign-in]. Only Mardi Davies has access [TO CONFIRM]. No system is perfectly secure, so please avoid sending sensitive details by unencrypted email where you can.
If we suffer a data breach that is likely to cause serious harm, we will act quickly, notify affected people and notify the Office of the Australian Information Commissioner (OAIC) as the Notifiable Data Breaches scheme requires.
How long we keep information
We keep client records for [TO CONFIRM, for example 7 years after your last session, or until a teen turns 25] because of tax, insurance and professional record-keeping needs. Enquiries that do not become bookings are kept for [TO CONFIRM, for example 12 months]. When we no longer need information, we securely delete or de-identify it.
Access and correction
You can ask to see the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Contact us using the details below. We will respond within a reasonable time, usually 30 days, and will explain if we cannot give access and why. Parents and guardians may ask on behalf of a teen, and we will consider the teen's age, maturity and privacy when we respond.
Complaints
If you are concerned about how we have handled your information, please contact us first. We will acknowledge your complaint within [TO CONFIRM, for example 5 business days] and aim to resolve it within 30 days. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
Changes to this policy
We may update this policy from time to time. The latest version is on our website with the date it was last updated.
