Coaching is not therapy
Coaching is a practical, goal-focused partnership. It is not therapy, counselling, or medical or psychological treatment, and it is not a substitute for any of these. Mardi holds a Bachelor of Science in Psychological Sciences and is a qualified Behaviour Specialist. Mardi is not a registered psychologist and does not diagnose or treat mental health conditions.
If you are struggling, please see your GP or a registered psychologist. In an emergency call 000. You can also call Lifeline on 13 11 14, or Kids Helpline on 1800 55 1800. We cannot guarantee any particular result. Your outcomes depend on many things, including your effort.
Who can book
You must be 18 or over to book for yourself. Teens aged 13 to 17 can take part in Teen Mindset only with a parent or guardian who agrees to these terms, pays for the program and is involved as we explain at the start [TO CONFIRM parent involvement rules, for example whether a parent attends part of the first session]. Parent and guardian consent is required before the first session. Organisations and schools are covered by a separate written quote and agreement [TO CONFIRM].
Bookings and scheduling
Your place is confirmed when we receive payment or agree a booking in writing. Fortnightly Recondition sessions and program sessions are scheduled together in advance. Please arrive or log in on time. Sessions that start late because of a late arrival still end at the scheduled time. Programs must be completed within [TO CONFIRM, for example 6 months beyond the program length] or unused sessions expire, subject to your rights under the law.
Payment
Payment is by card through Stripe. Stripe handles your card details. CONDITIONED. does not store them. Payment is due in full at booking unless we agree a payment plan in writing [TO CONFIRM whether instalments are offered]. We will email a receipt [TO CONFIRM tax invoice details].
Cancellations and rescheduling
You can reschedule or cancel a session with at least [TO CONFIRM, for example 24 hours] notice by emailing or messaging us. We will reschedule at no charge. If you give less notice or do not attend, the session may be counted as used [TO CONFIRM]. If Mardi has to cancel or reschedule, we will give as much notice as we can and offer a new time or a refund for the missed session.
Refunds
Money-back guarantee on the 60-minute consult. If you are not happy at the end of your 60-minute consult, tell Mardi at the end of the session. We will refund the consult fee in full to your original payment method within [X, TO CONFIRM] days. You do not need to give a reason, though feedback helps us. The guarantee applies to the first consult only [TO CONFIRM] and not to the program packages.
Program packages. If you stop a program part way through, we will consider a refund for unused sessions [TO CONFIRM policy, for example pro rata less any sessions used and any discount given]. We will treat each request fairly and in writing.
Your rights under Australian law. Our services come with guarantees under the Australian Consumer Law that cannot be excluded, including that services are provided with due care and skill. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have. If a service has a major problem, you may be entitled to a refund or compensation.
Transfers. Program packages are personal to the client who bought them and cannot be transferred to someone else [TO CONFIRM].
Your responsibilities
You agree to give accurate information, take part honestly, complete agreed actions, and tell us about anything that could affect your safety or ability to take part. You are responsible for your own decisions and for checking with your doctor before changing anything that affects your health. Please treat Mardi and other people with respect. We may end coaching if you behave abusively or unsafely, and we will refund unused sessions fairly.
Confidentiality and its limits
What you share in coaching is kept confidential. We will not share it without your consent, except where:
- we reasonably believe there is a serious risk of harm to you or someone else
- we have to by law, for example a court order or a mandatory reporting duty
- there is a child safety concern, in which case we may report to the appropriate authority
- we need to speak in confidence with our professional adviser or insurer [TO CONFIRM]
For teens, Mardi will explain at the start what stays between Mardi and the teen and what will be shared with a parent or guardian. Safety concerns are always shared. See our Privacy Policy for how we handle personal information.
Online sessions
You need a private space, a reliable internet connection and a device. We use [TO CONFIRM video platform]. Sessions are not recorded unless you and Mardi agree beforehand [TO CONFIRM]. If a technical problem on our side cuts a session short, we will make up the time. Please tell us if the problem is on your side so we can reschedule where possible.
Health funds
Some health funds may cover coaching under extras. Check with your fund before booking. We do not guarantee any rebate or that your fund will pay.
Intellectual property
Workbooks, audio files, videos, frameworks, app content and the website are owned by Mardi Davies or licensed to us. You may use them for your own personal coaching. You may not copy, share, sell or publish them without written permission. You keep ownership of what you create and share with us.
Testimonials
We will not use your name, story or image in marketing without your written permission, which you can withdraw [TO CONFIRM].
Liability
To the extent the law allows, CONDITIONED. is not liable for indirect or consequential loss, or for loss caused by things outside our reasonable control. Nothing in these terms limits liability that cannot be limited by law, including under the Australian Consumer Law. Where the law allows us to limit liability for a breach of a consumer guarantee, our liability is limited to resupplying the services or paying the cost of having them resupplied [TO CONFIRM wording with lawyer].
Website use
Please use the site lawfully. We try to keep information accurate but may change or remove content at any time. Links to other sites, such as YouTube, are covered by those sites' own terms.
Changes to these terms
We may update these terms. The version in force when you book applies to your booking. The latest version is on the website with its date.
Governing law
These terms are governed by the laws of Queensland, Australia [TO CONFIRM], and you agree to the courts of Queensland [TO CONFIRM]. Before taking formal action, we ask that you contact us so we can try to resolve the issue.
